Your access to and use of the service, which for caviarstar.com includes all aspects involved with receiving, processing and delivering on orders for food and serving ware products, is conditioned on your acceptance of and compliance with these Terms. These terms apply to all visitors, users and others who access or use the Service. By accessing or using the service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the service.

All other trademarks not owned by Caviar Star or its subsidiaries that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Caviar Star or its subsidiaries.

You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page, caviarstar.com, so long as the link does not portray Caviar Star, its associates, or their products or services in a false, misleading, derogatory, or otherwise offensive matter.

e.) You may not use any Caviar Star logo or other proprietary graphic or trademark as part of the link without express written permission.

3. Membership Accounts

a.) Caviar Star and its associates reserve the right to refuse service, terminate accounts, remove/edit content, or cancel orders, at their sole discretion, for all users whether registered or not.

b.) Users must release relevant information including, without limitation, first and last name, mailing address, phone number and email address in order to register an account. The account holder alone is liable for submitting accurate information. If Caviar Star or its associates assist a user in creating an account, the user is responsible for checking the information provided.

c.) If a user registers for an account and chooses an username, they are not allowed to choose usernames that may infringe trademarks.

d.) If you use this site, as an account holder or as a guest, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use our website only with involvement of a parent or guardian.

e.) We may terminate or suspend access to service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the terms.

d.) Caviar Star has the right but not the obligation to monitor and edit or remove any activity or content. Caviar Star takes no responsibility and assumes no liability for any content posted by you or any third party.

e.) Caviar Star's social media outlets, including Facebook, Twitter, Instagram, Pinterest, LinkedIn and YouTube offer protection by their own individual Terms and Conditions. Caviar Star may edit or delete any user's comments, posts, shares, messages, likes/dislikes or other content offered by the social media platform. Caviar Star may use unaltered content posted by users on caviarstar.com on any if the forementioned social media outlets.

f.) Links To Other Web Sites - Our Service may contain links to third-party web sites or services that are not owned or controlled by Caviar Star. Caviar Star has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Caviar Star shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

5. Electronic communications

a.) When you visit caviarstar.com, or send e-mails, comments, messages, and chats to us, you are communicating with us electronically and consent to receive communications from us electronically. Any email addresses, account links or chat communications provided or otherwise given by a user are allowed to be used by Caviar Star to initiate communication or reply to a user initiated communication.

b.) We are allowed to communicate with you electronically by sending emails to provided email addresses, chats through chat services, website comment and review sections, message platforms and by posting notices on this site.

c.) Registered users that sign up for our newsletter, have authorized Caviar Star to send promotional emails from caviarstar.com and various email marketing applications and programs to their authorized email address.

d.) You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

6. Products & Purchases

a.) If you wish to purchase any product or service made available through the online store, you may be asked to supply certain information relevant to your purchase including, without limitation, your first and last name, mailing address, phone number and email address. As the customer you must make sure your information is correct. Caviar Star can cancel any order with inaccurate shipping or contact information.

b.) Customers who have given credit card information are guaranteed to have their information protected through various authorization and protection services. It is the responsibility of the customer to submit accurate billing information in order to safe-guard their order. Caviar Star can cancel any order that does not process through our service due to inaccurate or falsified billing information. Orders with different billing and shipping addresses require personal authorization before shipment.

c.) Disclaimer of warranties and limitation of liabilities - caviarstar.com sells on an "as is" and "as available basis. Caviar star makes no representations or warranties of any kind, expressed or implied, as to the operation of this site or the information, content, materials, or products included on this site. You expressly agree that your use of this site is at your own risk.

d.) Caviar Star and its associates attempt to be as accurate as possible. However, Caviar Star does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Caviar Star itself is not as described, your sole remedy is to return it in unused condition.

e.) Caviar Star can cancel specific orders, at our sole discretion, if a product price is incorrect due to any error. We also reserve the right to cancel any order for reasons of inventory errors or discontinuation.

f.) All items purchased from caviarstar.com are made pursuant to a shipment contract. The risk of loss and title for such items pass to the buyer upon our delivery to the carrier.

7. Governing Law

a.) Caviar Star is incorporated and headquartered within the United States of America and operates its website within U.S. Law and North Carolina State Law.

b.) This agreement between Caviar Star and the users of our service is governed and enforced within U.S. Federal Law.

c.) By visiting caviarstar.com, you agree that the laws of the state of North Carolina, USA, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Caviar Star or its associates.

8. Disputes

a.) Any dispute relating in any way to your visit to caviarstar.com or to products you purchase through Caviar Star shall be submitted to confidential arbitration in North Carolina, USA, except that, to the extent you have in any manner violated or threatened to violate Caviar Star's intellectual property rights, Caviar Star may seek injunctive or other appropriate relief in any state or federal court in the state of North Carolina, USA, and you consent to exclusive jurisdiction and venue in such courts.

b.) Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrators award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

9. Site Policies, Modification, and Severability

a.) Please review our other policies, such as our Privacy Policy, Shipping and Returns policy, Chef and Distribution policy and Sustainable practice policy posted on this site. These policies also govern your visit to caviarstar.com.

b.) We reserve the right, at our sole discretion, to make changes to our site, policies, and these Conditions of Use to modify or replace the Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

c.) If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
